Understanding Workers' Compensation in Pennsylvania

In the state of Pennsylvania, if your workers’ compensation claim is denied, you have the right to file an appeal. The appeals process can be complex and requires a deep understanding of the law, but essentially, it involves challenging the decision made by the Workers’ Compensation Judge assigned to your case.

The first step in the appeal process is to file an appeal with the Pennsylvania Workers’ Compensation Appeal Board no later than 20 calendar days from the Circulation Date of the Judge’s Decision. The Circulation Date is on the front page of the Judge’s Decision. This appeal should specifically outline why you believe the Judge’s Decision was incorrect.

Once your appeal has been filed, both you, as the Claimant and the Employer and their Workers’ Compensation Insurance Company will have the opportunity to present both oral arguments and written briefs in support of your respective positions.

If the Workers’ Compensation Appeal Board (WCAB) agrees with the Workers’ Compensation Judge’s Decision, you can file a further appeal to the Commonwealth Court of Pennsylvania which must be filed within 30 calendar days from the Appeal Board’s Decision. The Commonwealth Court will then issue a written Decision after reviewing all of the submitted evidence.

If the Commonwealth Court does not issue a Decision in your favor, one last appeal can be filed with the Pennsylvania Supreme Court. A Petition for Allowance of Appeal must be filed no later than 30 calendar days from the Commonwealth Court’s Decision. It is up to the Supreme Court to decide whether or not to hear a case. If the Supreme Court will not hear the case, the Commonwealth Court’s Decision is final.

It’s crucial to note that each of these appeal processes can be lengthy and often requires legal expertise to ensure all documents are correctly prepared and deadlines met. That’s where Robinson Law LLC comes in. With Paula Robinson’s extensive experience in workers’ compensation appeals in Pennsylvania, she is well-equipped to guide you through each step of the process.

Why Was Your Workers' Compensation Denied?

In the Commonwealth of Pennsylvania, workers’ compensation is a type of insurance that provides wage replacement and medical benefits to employees who sustain an injury or illness as a direct result of their job. This system is designed to protect both employees and employers: it shields employers from civil lawsuits and ensures that workers receive the necessary support without having to prove fault.

To be eligible for workers’ compensation, you must meet the following criteria:

  1. Employment Status: You must be an employee of a company that carries workers’ compensation insurance. Independent contractors, freelancers, and certain other types of workers may not be covered.
  2. Work-Related Injury or Illness: Your injury or illness must have occurred in the course and scope of your employment. This includes injuries sustained while performing work duties, during work-related travel, or at a work-sponsored event.
  3. Timely Reporting: The injury or illness must be reported to your employer within 120 days of its occurrence.

It’s important to understand your rights and responsibilities under Pennsylvania’s workers’ compensation laws. If you’ve been denied these benefits, Robinson Law LLC is here to help you navigate the appeal process and ensure you get the support you’re entitled to.
